LUDINGTON — A Pere Marquette Township woman who stole her grandmother’s checks was sentenced to serve four months up front of an 11-month discretionary jail term Tuesday, April 11, in 51st Circuit Court for one count of uttering and publishing. Danielle Renae Perow, 29, of 1141 Daisy Lane, Lot 13, originally faced three counts of uttering and publishing, which is a 14-year felony, and three counts of identity theft, which is a five-year felony, said Mason County Prosecutor Paul Spaniola. The other five counts were dismissed in a plea agreement when she pleaded guilty to the one count. “I was given a check and I used it at the store, and the check was stolen,” Perow testified at an earlier hearing. The incident occurred at Walmart in Pere Marquette Township last October, the prosecutor said. Perow was ordered to pay fines and costs as well as restitution of $344.53 that is joint and several with a co-defendant. Editor LUDINGTON — A 26-year-old Sheridan Township man was sentenced to 7-40 years in prison in 51st Circuit Court Tuesday, April 11, for two convictions of breaking and entering with intent and fourth-offense habitual offender in connection to break-ins last August at Fountain Lumber Company and a pole barn. Gary Dean Maccune, of 2295 N. 34th Street, will serve two 7-40 terms concurrently, said Judge Susan K. Sniegowski. Maccune wept as the judge handed down his sentence. Maccune’s co-defendant Louis John Metheny Jr., 38, of 823 N. Benson Road, Fountain, was sentenced to an 8-40 year prison stint after pleading “no contest” to the same charges. The pair were charged with eight felonies apiece in connection with the break-ins. They have been lodged in the Mason County Jail on $15,000 bonds since their arrests. The other charges were dismissed in plea agreements. No additional charges are being pursued against Maccune or Metheny in Mason or Oceana counties as part of their plea agreements, Mason County Prosecutor Paul Spaniola said. Editor LUDINGTON — The 50-year-old Fountain man who was the accomplice to a parental kidnapping last January was sentenced in 51st Circuit Court Tuesday, April 11, to one year in jail for a conviction of conspiracy to commit unlawful imprisonment. Jeffery Alan Miller, 50, of 3728 E Beyer Rd., Fountain, aided Mark Alan Saporita-Fargo, 47, when he fled with his 2-year-old daughter, Hailey Hunter-Rose Fargo, the night before Saporita-Fargo’s scheduled trial in 51st Circuit Court for CSC charges. Saporita-Fargo and Miller triggered a statewide manhunt Jan. 24, 2017, when they tried to leave the state with Saporita-Fargo’s daughter. Miller drove Saporita-Fargo and his daughter in his black Ford Taurus about 200 miles to Hillsdale County. They were found at Miller’s mother’s and grandmother’s home, said Mason County Prosecutor Paul Spaniola. Saporita-Fargo pleaded guilty last week to third-degree criminal sexual conduct (CSC), which involved the sexual assault of a teenage victim in 2015, and conspiracy to commit unlawful imprisonment, stemming from the January 2017 kidnapping of Hailey. LUDINGTON — Shanin Nicholas Waite, 24, faces a prison term of 7-40 years after pleading guilty Tuesday, April 11, in 51st Circuit Court to three counts of breaking and entering with intent, attempted home invasion and fourth-offense habitual offender after going on a crime spree last fall that victimized local businesses. Waite testified that he broke into the King Funeral Home, Lower Hamlin Grocery Store and Little Caesar’s Pizza. He also attempted to break into a residence. He was initially facing other serious felony charges, including safe breaking and car theft, but those charges were dismissed in a plea agreement. Mason County Prosecutor Paul Spaniola said Waite’s fourth-offense habitual offender designation elevated his maximum penalty to life in prison. Waite testified that he threw a rock through the window at King Funeral Home and climbed through the window. He stole a minivan from the funeral home, as well as $40 in cash and an ipod. LUDINGTON — A Ludington man will be going to trial for sex crimes involving a minor. Robert Lee Carr, 33, of 614 E. Dowland St., appeared in 51st Circuit Court today and turned down a plea agreement by the Mason County Prosecutor’s Office, thus turning the matter over to a trial. Carr, 33 was arrested Feb. 2, 2017 by the Ludington Police Department on felony charges of child sexually abusive activity or material, a felony punishable by a maximum of 20 years in prison; using a computer to commit a crime, a felony punishable by a maximum of 20 years in prison; second-degree criminal sexual conduct (victim under 13), a felony punishable by up to 15 years in prison; and second-offense habitual offender, which elevates the first count to a maximum of 30 years in prison. His bail was set at $75,000 cash/surety and he remains lodged at the Mason County Jail. LUDINGTON — A 30-year-old Ludington woman was sentenced to serve one year in jail in 51st Circuit Court Tuesday, May 9, for convictions of receiving and concealing a stolen firearm and second-offense habitual offender. Tabatha Christine Humphreys, of 503 N. William St., Apt. A, pleaded guilty to the charges last March. Humphreys was arrested last December by the Mason County Sheriff’s Office for a Sept. 26, 2013 incident, initially facing felony charges first-degree home invasion and two counts of felony firearms, which were dismissed in a plea agreement. Humphreys testified in March that the firearm was a stolen .38 Special Revolver. Humphreys has remained lodged in the Mason County Jail on a $75,000 cash/surety bond. In addition to the year in jail, Humphreys was ordered by Judge Susan K. Sniegowski to serve three years probation, which includes a substance abuse evaluation. She was also ordered to pay restitution totaling $1,000 that is joint and several with her two co-defendants as well as $400 in extradition costs from the State of Indiana. LUDINGTON — A 23-year-old Branch man was sentenced to 20-50 in years in prison in 51st Circuit Court Tuesday, May 9, for a conviction of first-degree criminal sexual conduct (CSC) involving the repeated sexual abuse of a 12-year-old boy. Jordan Daniel Bates, of 1946 S. Shepperd Rd., pleaded guilty March 14 to the charge. In exchange for his plea, three counts of first-degree CSC and three counts of second-degree CSC were dismissed. Bates will be subject to lifetime electronic monitoring and tier-three sex offender registration upon his release from prison, said Mason County Prosecutor Paul Spaniola. The pre-sentence investigation (PSI) report “paints a very dark picture of sexual abuse,” Spaniola said, describing the “repeated sexual abuse” of the child. LUDINGTON — A 24-year-old Summit Township man was sentenced to serve 77 days up front of a one-year discretionary jail term Tuesday, May 9, in 51st Circuit Court for a conviction of unlawfully driving away a motor vehicle (auto theft). Tyler Joe Brown, of 4245 W. Anthony Rd., received credit for 77 days served in jail. Judge Susan K. Sniegowski also ordered that Brown serve two years probation. He was arrested last February by the Mason County Sheriff’s Office after striking a power pole with the stolen vehicle, said Mason County Prosecutor Paul Spaniola. Brown recently pleaded guilty to operating while intoxicated in Oceana County, but has yet to be sentenced, the prosecutor said. His Mason County term runs concurrently with his Oceana County case. LUDINGTON — The following were recently arraigned in Mason County’s 79th District Court: Felonies -Kevin Ryan Shook, 30, of 202 S. Rowe St., Apt. 2, Ludington, was arrested April 27 by the Ludington Police Department (LPD) on a felony charge of assault/resisting/obstructing police. Preliminary hearing: May 31 at 11:15 a.m. Bail: $5,000 personal. -Jared Adam Canales, 48, of 2510 Pine Grove, Muskegon, was arrested May 15 by the State, Sheriffs’, Chiefs’ Enforcement of Narcotics Team (SSCENT) on felony charges of possession of a controlled substance and fourth-offense habitual offender. Preliminary hearing: May 31 at 11:15 a.m. Bail: $5,000 personal. -Kristina Mackenzie Haynes, 37, of 608 5th St., Ludington, was arrested May 13 by the Mason County Sheriff’s Office (MCSO) on felony charges of first-degree retail fraud (shoplifting) and second-offense habitual offender. Preliminary hearing: June 7 at 11:15 a.m. Bail: $3,500/10 percent. -Peter Allen Jabrocki, 60, of 94 N. Meyers Rd., Amber Township, was arrested May 10 by Michigan State Police (MSP) on felony charges of alter/forge/falsify vehicle documents, operating an unregistered vehicle and failure to maintain security (no vehicle insurance).
